Discussion Week 8

Q This year we've read updates about Justin "Jussie" Smollett, actor in the TV program Empire, who was charged with felony disorderly conduct for allegedly filing a false police report. One of the issues that has surfaced is that he paid two brothers $3,500 with a check that had written in the memo line "payment for 5 week Nutrition/Workout program (Don’t Go)”. But police and prosecutors say the check, dated Jan. 23, 2019, is evidence that the 36-year-old paid Osundairo and his brother Olabinjo to carry out the hoax assault in Chicago six days later. Take the information we reviewed in Chapter 15 and write your opinion on the matter: do you think Jussie's note on the check's memo line coincides with the potential truth that the bodybuilder brothers would be helping him train for an upcoming music video? Or is the notes section on a check -a negotiable instrument, once written to hide the truth? You may need to refer to the latest stories in the news like these as well as read the chapter and make an outline for yourself. Write at least 2-3 paragraphs based on your opinion. You will be awarded 16 points for posting only your discussion and 4 additional points for posting feedback to another student's post.

As we have learned, a negotiable instrument is transferable from one person to another. The holder in due course is the party who receives the negotiable instrument in good faith as a settlement for an obligation. The check in the Jussie Smollett’s case is an example of a negotiable instrument. There is no question about the negotiability of the instrument because it is in writing, duly signed by Smollett, and is payable on demand to the order of Osundairo and Olabinjo.
